The Federal Constitution of 1988 of the Federative Republic of Brazil, among the general principles of economic activity, in art. 170, item IX, granted favored treatment to micro and small companies and, in its art. 179, granted differentiated legal treatment in order to encourage them by simplifying their obligations (BRASIL, 1988). Complementary law No. 123/2006 and the new law on bids and administrative contracts, Law No. 14133/2021, ensured the application of benefits to MSEs in accessing the public procurement market (BRASIL, 2006; 2021). The Statute and Institutional Development Plan 2020 – 2029 of the Federal University of Rio Grande do Norte defined among the principles to be achieved by the Institution, the contribution to the “socioeconomic development of the state, region and country” (UFRN, 2002; 2020). For this purpose, exclusive participations and quotas reserved for micro and small companies are granted in the public notices of bidding processes in the electronic auction modality, carried out by the Federal University of Rio Grande do Norte. It so happens that these benefits are being wasted by many of these companies. And, factors that are crucial for the non-permanence of micro and small companies in the market are pointed out, among them are insufficient working capital and lack of customers (SEBRAE, 2014). Aiming to identify and analyze the factors that have contributed to the disqualification of MSEs when participating in electronic auctions carried out by UFRN, this research, applied in a federal institution, is descriptive by segmenting the role of micro and small companies in bids in the auction modality, in in electronic form, carried out in the period between 2019 and 2021. The research will use a bibliographic methodology to consult current legislation and regulations, documents, for access to reports generated by the institution's internal data system and the federal government's procurement portal. Through a focus group, with the internal actors who conduct the electronic auctions in the researched institution, to verify their perception in relation to the factors that lead micro and small companies to be disqualified in such bidding events.Electronic questionnaire with representatives of MSEs participating in the electronic auction in the researched body, to record reports of obstacles that hinder this participation, and, semi-structured interview with SEBRAE/RN, FIERN/RN and FECOMÉRCIO/RN about the support offered to MSEs in relation to capacity building for full participation in these tenders. Analyzing and comparing this perception with the collected data will be important to deepen the intended diagnosis. This, the result of the research to be carried out, will allow course corrections in terms of critical analysis based on the requirements contained in the notices, prior directive and orienting communication to the companies and the proposition, through a service letter, improvements to the purchasing system, via electronic auction, as a way of fully complying with the legislation supporting MSEs.
