SUMMARY:

This study analyzes the use of credit cards as an alternative means of payment in labor enforcement proceedings and labor conciliation, based on the identification of difficulties faced in the satisfaction of judicial credits. The research is situated in a context in which creditors do not always receive, in a timely manner, the amounts recognized in court; debtors may lack immediate liquidity to fully discharge their obligations; and the Judiciary faces operational barriers and high congestion rates during the enforcement phase. The objective of this research is to develop and analyze an institutional model for judicial payment by credit card, aimed at expanding the possibilities of payment compliance and increasing the effectiveness of labor enforcement and conciliation. The relevance of the study lies in the need to overcome the low effectiveness of labor credit satisfaction, broaden traditional means of payment, and bring the formal recognition of rights closer to their material realization, in accordance with the notion of substantive access to justice. Methodologically, this is an applied study with a qualitative, exploratory, and descriptive approach. The research was developed through desk research, normative and documentary analysis, immersion, ideation, prototyping, and incremental evaluation, supported by Design Thinking and Lean UX approaches, as well as workshops aimed at understanding the problem, constructing hypotheses, and progressively validating the solution. As its main results, the study identified the feasibility of structuring a judicial payment model linked to a specific legal proceeding and integrated into the Brazilian Payment System, capable of dissociating the moment of receipt by the creditor from the debtor’s payment flow. The proposed solution allows the creditor to receive the full amount, while the debtor pays the obligation in installments through the financial institution, without altering the judicial nature of the transaction. As a technical-technological product, the study presents the modeling of an institutional arrangement for judicial payment by credit card, accompanied by the systematization of legal, operational, financial, and technological requirements, as well as guidelines for its institutional implementation and replication. The study concludes that the incorporation of financial instruments into the judicial environment constitutes an incremental innovation with potential social and institutional impact, as it may reduce the time required for credit satisfaction, expand payment alternatives, strengthen conciliation, and contribute to the effectiveness of judicial protection.
