SUMMARY:

This study aims to analyze the hermeneutics of the female body produced by legal discourse through criminal cases in the Caicó Judicial District (1930–1949), focusing on crimes such as rape, physical assault, homicide, and attempted homicide. Therefore, to achieve our objective, we focus on determining the roles played by women in criminal proceedings in the Seridoense hinterland during this time period, on identifying a female cartography constructed through the procedural investigation of the analyzed crimes, and on investigating how medical-legal discourse formulated an interpretation of the female body through the forensic medical examinations that constitute part of the procedural investigation. We understand that “femininity” is a socially constructed category throughout history, thus, we seek to understand how the female body in the Seridoense hinterland was constructed as a subject through legal-procedural discourse. We recognize that femininity has long been overshadowed by masculinity in the Seridoense hinterland, a region characterized by patriarchal traditions, for this reason, we view women as the “other” agent shaping the hinterland’s space and history. Theoretically and methodologically, we base our analysis of criminal proceedings on Michel Foucault’s discourse analysis, taking into account the encounter between women’s bodies and the state’s judicial power, in conjunction with Joan Scott’s discussions of gender and Carole Pateman’s perspective on the sexual contract.
