SUMMARY:

The implementation of the right to access public information, even after the enactment of Law No. 12,527/2011, known as the Brazilian Access to Information Law (LAI), still represents a challenge for both public administrators and society, which seeks greater participation in public affairs. This scenario, marked by various informational barriers, hinders the full realization of this right. The challenge becomes even more complex in the context of federal autonomous agencies, such as the Regional Councils of Physical Education (CREFs), in which each council, while complying with the limits established by the LAI, holds autonomy in organizing and disclosing information necessary for the professional practice of physical education. Such autonomy directly affects registered professionals’ perceptions of institutional trust. In light of the gaps left by the LAI, the Inter-American Model Law 2.0 on Access to Public Information emerges as an important instrument for strengthening active transparency and fostering citizen participation. In this context, the present research seeks to answer the following question: how can active transparency in the Regional Councils of Physical Education be improved based on the recommendations of the Inter-American Model Law 2.0? The general objective is to understand how these recommendations may be applied to enhance active transparency within the CREFs. The study adopts a mixed methodological approach of an exploratory and descriptive nature. Qualitative procedures, such as document analysis and semi-structured interviews, will be employed, alongside quantitative procedures through the application of structured questionnaires to professionals registered with the CREFs. Data analysis will be conducted using content analysis techniques for qualitative data and descriptive statistical analysis for quantitative data, enabling a comprehensive understanding of the level of active transparency practiced by the Regional Council of Physical Education of the 16th Region of Rio Grande do Norte (CREF16/RN) and professionals’ perceptions regarding its effectiveness. The research is expected to identify physical education professionals’ perceptions of transparency levels within CREF16/RN and its impact on institutional trust, as well as the perspective of those responsible for implementing transparency measures. Through this bilateral analysis, the study also aims to examine how the Inter-American Model Law 2.0 on Access to Public Information can provide normative parameters to improve transparency and stimulate citizen participation among registered professionals.
