SUMMARY:

In 2011, Brazil took an important step towards public transparency with the promulgation of Federal Law No. 12,527. This law, which regulates the right to information provided for in the 1988 Federal Constitution, establishes that public bodies at all spheres and levels of government must proactively disclose information of collective or general interest, as a tool of social control. The present study will have as its thematic focus the analysis of active and passive public transparency, in light of what establishes Federal Law No. 12,527 of 2011. In general, active transparency encompasses the information that public managers must publish to the population without being required previously. Passive transparency, in turn, makes it a right for anyone to request access to necessary public information. The research aims to understand the management of public transparency in municipalities in the Metropolitan Region of Natal, based on the focus of state capacity in its technical-bureaucratic dimension, to comply with the guidelines of Law 12,527/2011. Therefore, the following questions arise: how have the municipalities in the functional Metropolitan Region of Natal implemented active and passive public transparency? How is the state capacity of the municipalities in the functional Metropolitan Region of Natal characterized for managing public transparency? This work is characterized as a qualitative study, carried out from a multiple case study that will present an exploratory and descriptive approach. To this end, bibliographical and documentary research will be carried out, as well as the application of semi-structured interviews with selected actors to collect data and information. As partial results, this document presents a theoretical framework with a discussion of public transparency and state capabilities. In addition to the project structure, a chapter that will make up the dissertation will be presented: chapter 2, with a debate around municipal challenges related to Brazilian public transparency at the municipal level.
