SUMMARY:

The collection of recyclable materials is an essential activity for the recycling chain and, therefore, for achieving "sustainable development." However, the people who perform this work—recyclable material collectors—find themselves in extremely precarious labor situations, lacking the means to access basic rights such as healthcare, labor dignity, and social security. In light of this, and considering the tactical and political use of insurgent law and legislation, this work aims to qualitatively and quantitatively analyze Brazilian state and district legislation regarding recyclable and reusable material collectors and identify metrics that can be used by states to assess the quality of local legislation on recyclable materials collectors and identify regulatory gaps. To this end, we used documentary research and a mixed descriptive approach (qualitative and quantitative) based on the regulatory framework of all Brazilian states and the Federal District, collected using Zotero software through research in the "State Laws" database and on the websites of the State Legislative Assemblies and the Legislative Chamber of the Federal District. This data was then exported to VOSViewer software for network analysis. The research revealed that state and district legal regulations are generic, offering few provisions regarding the life quality of the waste picker population. The most protective state laws for the category are those of the states of Minas Gerais and Rio de Janeiro. Therefore, further studies were conducted on the regulations of Minas Gerais and Rio de Janeiro, which resulted in the identification of four legal metrics of Environmental Justice that can be used by other states to identify gaps in their legislation and create new, more protective laws. The studies thus enabled the development of a model for states to follow to achieve a higher level of legal protection for the category and guarantee more fundamental rights to the waste picker population. Based on the results achieved and presented, the aim is to assist the legislative and executive branches of the states in developing legal norms that advance the Brazilian legal framework toward guaranteeing rights for the class.
