SUMMARY:

The fundamental right to education constitutes one of the principal instruments for human development and the promotion of substantive equality. The low number of transgender individuals who complete basic education diverges from the orientation of this social right, as established in Article 206, I, of the Federal Constitution, which safeguards not only access to education but also students’ continued attendance therein, thereby making imperative the study of the factors that may lead to the dropout of these students from educational institutions. Accordingly, the present study examines the use of social names by transgender students under eighteen years of age. The research is situated within the field of Brazilian educational law by analyzing the relationship between inclusive education, integral protection, and progressive autonomy, with emphasis on the regulation established by Resolution CNE/CP No. 1, of January 19, 2018. The study focuses on the analysis of the requirement for legal guardians’ intermediation in requests for the use of social names by underage students, seeking to investigate whether the regulation omitted protection for those who do not have family authorization. Thus, the study aims to investigate the compatibility of the normative regulation of social name usage with the principles of integral protection and progressive autonomy, through an analysis of the right to education, the regulation enacted by the Conselho Nacional de Educação, and the advances of state regulations concerning the use of social names. Based on theoretical research, employing a qualitative approach and descriptive objective, it was demonstrated that the recognition of social names constitutes an important mechanism for school retention and the realization of the right to education, being closely related to the free development of personality and the integral protection of children and adolescents. Nevertheless, it was verified that the national regulation was omissive insofar as it conditioned the exercise of this right upon parental intermediation without providing mechanisms directed toward students who lack family support. It is concluded that the effective realization of the right to education requires an interpretation of civil and educational law compatible with progressive autonomy and integral protection, making it necessary to improve the educational public policy in order to ensure recognition of the identity of transgender students within educational institutions.
