LABOR ENVIRONMENT: an analysis of bullying and its offense against the constitutional principle of the dignity of the human person

The present study presents the workplace environment and the suffering
suffered by the same when the occurrence of moral harassment, violence that
affects the dignity of the human person. From the bibliographic research it is
evident in the first chapter the conceptualization and characterization of the
environment and it includes the work, as well as its pioneering protection
provided for in the Federal Constitution of 1988, which was assigned a whole
chapter. In a sequence, the transformations in the world of work and its relation
with moral harassment will be studied, pointing out the historical, conceptual,
types and subjects involved in this violence, which occurs in the public and
private sectors, but with peculiarities in the first, being characterized by
Constant sufferings and humiliations, which substantially shake the well-being
at work, triggering a series of harmful consequences for the health and life of
the worker. In a third moment, a focus will be given to bullying in public
administration, demonstrating the relationship between its occurrence and the
violation of administrative constitutional principles. State civil liability for
damages caused by public agents, their administrative responsibility and laws
on moral harassment in the states and municipalities, as well as the need to
criminalize such harassing conduct will also be worked on. The methodology
covers bibliographic research, through books, articles, monographs, periodicals,
internet and legislation. In the conclusions it was possible to show that
ignorance about the issue, impunity and legislative omission are among the
main causes of its occurrence, being decisive factors for a significant reduction,
criminalization of the conduct, its legal recognition as an act of administrative
improbity And the holding of permanent campaigns for the dissemination of
information on the subject.
