SUMMARY:

The text of the Constitution states that one of the foundations of the Federative Republic of Brazil is free competition, defining a set of requirements and objectives that must be guaranteed by the State so that there is a market that promotes fair competition. A country that is based on free competition must guarantee that all individuals can exercise their constitutional rights. Brazil values freedom, justice and development, such objectives cannot be achieved if the majority of society is on the margins of the market. A country that legally values freedom promotes barriers for women to enter the market. Women daily face obstacles created by society itself, double shifts, unequal wages, discriminatory policies, which results in a country where the majority of the population is made up of women, who represent a smaller workforce. Through the integration proposed by free competition, the entry of women into the job market is discussed as a guarantee of development, using legal mechanisms and public policies to promote market balance and achieve the goals established in the Federal Constitution 1988. The objective is to expand legal mechanisms and national policies to allow women to enter the job market, from the perspective of free competition, contributing to national development. Finally, data was collected, analyzed from the perspective of the constitutional text, plus bibliographic consultations to understand the current state of the country from a legal perspective. It can be concluded that the objective of balancing the job market is still a distant reality, Brazil is developing late. Currently, the majority of Brazilian households are headed by women, where the highest unemployment rate is concentrated, which directly contributes to the lack of development and vulnerable situations. A woman who does not work is a woman without income, without income there is no development. It appears that free competition is an instrument for promoting national development, the introduction of women into the job market significantly expands the set of available skills and talents. This, in turn, promotes innovation, productivity and competitiveness in the economy.
