SUMMARY:
The international migration flows, exacerbated in recent years by the process of globalization, impact modern society with the weight of space reconfiguration and changes in social dynamics. Based on this premise, the following question arises: "Does the Brazilian legal framework observe and implement national and international regulations related to the right to education for immigrants in situations of socioeconomic vulnerability?" Thus, the present study aims to analyze the impacts of the realization of the right to education for immigrants in situations of vulnerability within the Global Human Rights Protection System, the Inter-American Human Rights Protection System, and within Brazilian legislation. For this purpose, the following specific objectives were outlined: to contextualize the national and international regulations that focus on the protection of migrants' rights; to study the legal and jurisprudential provisions related to International Right to Education (IRE); and finally, to examine the implementation of IRE for immigrants in Brazil. In order to achieve the outlined objectives, the inductive approach method and qualitative research were used. In the data collection process, indirect documentation was chosen through documental and bibliographic research. In its results, it was possible to conclude that the studied normative systems have guided the pursuit of education as a key movement for the realization of human rights for individuals in international mobility who find themselves in vulnerable conditions. However, despite the formalistic attempts discussed, the collected data still point to a lack of effective access to the educational system and marginalization of the group under study.
