SUMMARY:

The health federalism crisis is a subject that prevails today, having emerged in the Covid-19 pandemic. In addition, the legislative shocks edited by the federative entities due to their constitutional nature of concurrent competence have brought several narratives about which public policy is the most effective to be applied and how the sanctioning administrative law is seen in this scenario. In this context, issues related to aspects of fundamental service rights and how they can be effective in the context of the application of information and communication technologies will be addressed. Thus, it is evident that the problem of the theme revolves around the following question: to what extent can the application of information technologies and the sanctioning administrative law corroborate with the improvement of the effectiveness of legislation and public policies edited in the face of the crisis of sanitary federalism? The study of the chosen theme is important because, in addition to being a contemporary situation, the application of public policies in the light of fundamental rights within public health can be the object of improvements for society and the prevention of future pandemics. Among the difficulties pointed out, the objective is to establish efficient techniques to control the health crisis, taking as a parameter what happened in the Covid-19 pandemic with technologies that can integrate a new perspective of interpretation of norms and application of public policies in the Municipalities. As methodological procedures, hypothetical-deductive research is used, with a qualitative approach to investigate the conduct of legislators and managers of Municipalities, observe the sanctioning administrative policies adopted, identify strategies in public policies that can be used to improve the crisis and analyze benefit rights, the light of the constitutional right to health from the behavioral perspective of coping with the pandemic and the crisis of federalism. The research procedure adopted was bibliographical and jurisprudential. It is concluded that: the theme is provided for in the infraconstitutional legislation by law nº 13.979/2020 and mainly by the Federal Constitution of 1988, but it still needs more in-depth studies and investments to solve practical issues, especially with regard to the application of the use of technology to provide public policies in the area of health and in ordering the administration of sanctions.
