SUMMARY:

The reservation of vacancies for access to the judiciary is a way of materializing the principle of equality in its three facets, formal equality, material equality, or redistribution, and equality as recognition. The issue is important to enable better pluralism and cultural diversity within the judiciary, thus contributing to a more efficient provision of justice to the public in general. In this context, address the issues related to the affirmative policy of racial equity for access to positions in the judiciary, especially through an analysis of Resolution n. 203/2015 of the National Council of Justice. It is evident that the problem of reservation of vacancies for afro-descendants in magistrature competitions is embodied in the following questions: how can Resolution n. 203/2015 of the National Council of Justice contribute to the promotion of racial equity in access to magistrature positions in Brazil? Is there pertinence and sufficiency of the reservation of vacancies for Afro-descendants in the competitive examination for the judiciary? The study of the chosen theme is important because it brings positive changes with evident consequences for the social, economic, and legal reality, given the greater representation of diversity found in the population reflected in the institution of the magistrature. In this sense, the need to promote racial equality in the Brazilian judiciary is visible, since this career is composed predominantly of white people, which can affect impartiality and the diversity of perspectives in judicial decisions. Among the difficulties pointed out, the objective is to analyze the obstacles to the realization of equity in the judiciary according to the diversity found in the general population; for this, it is necessary to study how the Resolution 203/2015 of the National Council of Justice can contribute to the promotion of racial equity in access to judicial positions in Brazil. It employs, for this, the research of applied nature, with theoretical type, from the use of logical-deductive method and qualitative approach; moreover, it presents descriptive objective and bibliographic, documentary and legislative procedure. We conclude that the theme is foreseen in the principles of article 5º, caput, of the Constitution of the Federative Republic of Brazil of 1988, and in Resolution 203 of the CNJ, which is an important instrument for the promotion of racial equity in the access to magistrature positions in Brazil, but its implementation still faces significant challenges. It is necessary to continue monitoring and evaluating affirmative policies to ensure that they are effective in promoting diversity and equal opportunities.
