SUMMARY:

The advances brought by the digitization of both social or commercial relations caused significant changes in Brazil and in the world. In a context of “datatification” of the economy generated by the information society, where data, or sets of organized information, have high economic power and have become a bargaining chip, it is possible to notice an association between the accumulation of this new type of patrimony and the dominance of capital and power. In this scenario, violations of rights related to the obtaining or misuse of personal data, those attributed to an identified or identifiable person, have become more commonplace. On the global stage, the European Union took the lead in regulating the subject with its General Data Protection Regulation, known by its acronym “GDPR”, which served as a technical-normative parameter for the advent of the Brazilian General Data Protection Law, the “LGPD”. It is observed that the hyposufficiency of internet users is aggravated by the lack of mastery of basic skills in handling devices such as computers and smartphones, especially by the portion of the population that has been growing in recent decades and is not so used to technological innovations: the elderly. Going through the challenges mentioned above, without forgetting the structural obstacles such as difficulty in accessing the network and lack of financial conditions for the acquisition of electronic devices, this work aims to analyze the impact of digital education for the elderly in the construction and development of this new Brazilian moment, marked by new habits and digital realities, to what can be called a culture of data protection. To do so, the hypothetical deductive method will be used to understand its impact on this new order, making use of bibliographic and documentary sources such as doctrine in digital and constitutional law, survey of legislation and bills related to the subject, with the contribution of scientific articles from national and foreign sources for the design of the encompassed scenario, its challenges, and possibilities. In addition, the role of the National Data Protection Authority (ANPD), the LGPD regulatory body and data protection regulator in the country, was studied in the face of the problem, through its actions and publications already available. It is concluded that the digital education of the elderly is of paramount importance for the development of the Brazilian data protection culture, not only due to its population impact, but because this true culture must actively and faithfully involve the entire Brazilian society.
