SUMMARY:

This study aims to intersect the data between the constitutional-electoral process and the conceptualization of representation with diversity in politics, from the existing incentive actions, as is the case of legislation. It is noticed that, over the years, women suffered a late entry into the public space, being the state of Rio Grande do Norte the pioneer in the insertion of the female gender in electoral elections, which, until then, sustains this title, as observed in the elections from 2004 to 2012 and 2016 to 2022, as catalogued by the Superior Electoral Court, the regulatory body of elections. Furthermore, despite universal suffrage, women do not achieve expressiveness to occupy seats in parliament, considering them with low political representation, therefore, a minority in a space of collective decision-making. Therefore, this research asks: in what way the isonomic electoral legislation allows the representation with diversity in Rio Grande do Norte? And, if not, how is this inequality constructed? The hypothesis is that there is a large number of women in the electorate, including running as councillors, but who do not manage, effectively, to be elected. The methodology is quali-quantitative, with a descriptive objective and a literature review. The result is that the women are in under-representation due to the under-financing of their electoral campaigns, being captured by the time destined the activities of the care, as maximum premise elaborated by the hegemonic power, to make its proper maintenance, from a neoliberal politics, treating the democracy as market and not as instrument to the human dignity. Therefore, it is necessary to review the system of proportional elections by open list, in local politics, under penalty of remaining a process without transparency and with the possibility of orange candidates, which occurs in less probability in the majoritarian systems. Furthermore, it is necessary to review the incentive actions, applying gender mainstreaming as a way to measure the democratic quality of the electoral process, using class, gender and race clippings, in a materialist, intersectional and decolonial epistemological perspective, as these are intertwined and therefore complementary to each other, obeying the normative command of political and electoral rights as human and fundamental.
