SUMMARY:

The objective of this dissertation is to assess the ethical and regulatory aspects related to the implementation of artificial intelligence-based solutions in the Brazilian judiciary. To achieve this, we conducted an analysis of data obtained through a questionnaire administered by the Court of Auditors (Tribunal de Contas da União) in the case TC 006.662/2021-8, as well as a systematic literature review using the PRISMA method. We examined issues concerning justice, responsibility, and transparency in the development of artificial intelligence across 45 courts comprising the Judiciary of the Union, considering the framework known as "FAT" (Fairness, Accountability And Transparency). Our analysis also addressed technical and structural support aspects of organizations in implementing artificial intelligence. Initially, we conducted a literature review on artificial intelligence and the "FAT" framework, which serves as a minimum ethical model for implementing artificial intelligence solutions. Subsequently, we discussed Resolution No. 332/2020 of the National Council of Justice, which addresses ethics, transparency, and governance in the production and use of artificial intelligence in the judiciary, establishing guidelines for the development and utilization of AI. We also analyzed graphs derived from data obtained by the Court of Auditors. In the systematic literature review, we sought to identify the main challenges in ethically implementing artificial intelligence systems and the primary risks associated with using AI that does not adhere to ethical parameters. The responses provided by the courts indicate a lack of adherence to the FAT framework, as the criteria related to justice, responsibility, and transparency were not observed by the questionnaire respondents. Consequently, there is also a failure to comply with relevant aspects of Resolution No. 332/2020-CNJ, which aligns with the FAT framework. Moreover, through the systematic literature review, we identified an urgent need for regulation of artificial intelligence and the establishment of clear standards for its implementation, ensuring that the definition and application of ethical principles are accessible and transparent. In conclusion, the use of artificial intelligence without adequate ethical parameters can pose significant risks to individuals, including violations of fundamental rights and the perpetuation of inequalities and discrimination.
