SUMMARY:

Empirical transnational research indicates that between the years 2000 and 2015 the levels of growth in women's incarceration increased sharply and much more rapidly than the levels of male incarceration and, in contrast to the latter, the phenomenon occurred on all continents, at levels three, four, and even five times greater than population growth. At the same time, there was a process of intense transformations in the pattern of accumulation of capital after the 1973 crisis that resulted in changes in social relations, institutions, and the processes of economic reproduction, which configure neoliberalism. The aim of this dissertation is to seek a theoretical explanation for the relationship between the global increase in the criminalization of women and the advent of neoliberalism from the unitary apprehension of capitalist social relations that informs Social Reproduction Theory. The recent Social Reproduction Theory of Marxist feminism rescues the Marxian notion of social totality and the dialectical historical materialist method that informs it for a unitary understanding of the social relations that co-constitute the capitalist social totality. As a unitary theory based on the notion of social reproduction, the Theory of Social Reproduction is able to grasp at a higher level of theoretical abstraction - in a total, integrated, dynamic, non-deterministic, non-reductionist and non-functionalist way - the entanglement between the global increase in the criminalization of women and neoliberalism, refuting fragmentary and dichotomous theoretical understandings that restrict analyses of neoliberalism to the strictly economic sphere as opposed to the relations of oppression existing exclusively in the social and cultural sphere. This is, therefore, an explanatory research with a qualitative approach, which uses bibliographic and documental revision techniques, based on the dialectical historical materialist method. The work is composed of three chapters, besides the Introduction and Final Considerations. The first chapter presents the accumulation of debates that gave origin to the Theory of Social Reproduction, establishing fundamental notions to understand the complex, necessary, and contradictory relationship between production and social reproduction in capitalism. Next, the second chapter seeks, based on dialectical historical materialism, to understand the co-constitution of social relations of gender, race, and class in the capitalist social totality, as well as the social forms of law and the state. At this point, this research finds dialogue in Guilherme Leite Gonçalves' theory of the social-legal reproduction of capitalism, which seeks to point out, through the theory of expropriation and the notion of primitive accumulation, how law appears as explicit legal violence in the expansionist moment of capital accumulation. In the last chapter, Gonçalves' theory about the mode of social-legal reproduction of financial capitalism will be articulated based on the insights about the neoliberalization of social reproduction that come from the Theory of Social Reproduction. With this, the research points to the construction of a theoretical explanation for the increase in the criminalization of women based on the transformations in the sphere of social reproduction brought about by neoliberalism, overcoming the limits of critical descriptive research and/or that situates the phenomenon in a merely contingent manner.
