SUMMARY:

This work deals with the theme of the Inter-American System and of the individual's direct access to the Inter-American Court, with a view to further promoting international human rights law in America. In this context, issues related to access to Justice and the Supranational Courts for the Protection of Human Rights will be addressed, with a focus on the figure of the individual (as a direct petitioner). The structure of the Organization of American States is a matter of special treatment. Furthermore, an attempt is made to understand in depth the system of the Inter-American Court, by conducting a study compared to the system defined by the European System, with its International Court of Human Rights, considered a world exponent in this matter. It is imperative to affirm that direct access (by the individual) to the Inter-American Court is still a matter in question. The general objective of this research is to: understand the Inter-American System with regard to the relevance of direct access by the individual to the jurisdiction of the Inter-American Court, with the backdrop of this instrument being an element of promotion of International Human Rights Law in the American continent, as well as in the Caribbean region. The specific objectives are: to address access to justice and access to international courts (supranational courts) from the perspective of the individual (as a subject of international law); focus on the Inter-American System with the importance of the Commission and the Court; and, finally, to establish the understanding of the need for direct access to the Inter-American Court (by the individual), necessarily making an analysis compared with the European Court. The applied methodology consists of the bibliographic research procedure, the deductive logical method is used in the text, covering notes from the Inter-American System, access to the Inter-American Court, the relevance of the ECtHR in terms of human rights, as well as doctrinal sources from applied social sciences, especially international law. It is concluded that the direct access, established by the individual before the Inter-American Court, leads to a promotion of international human rights law in the American continent, establishing the human being as a subject of law and extolling a great rescue of his dignity.
