RESUMO:

The human right to appropriate feeding has constitutional provision in domestic legal order and human rights international regulations ratified by Brazil. Thus, the Right to appropriate feeding is a fundamental right, which is inserted in the bloc of what is considered a minimum right to the existence of an individual, which must be safeguarded as an obligation of the Rechtsstaat. Endemic hunger in the country is a theme of important social and legal relevance, since with all legislative development of Human Rights protection, in international context, and fundamental rights, in domestic context, hunger is still present affecting, in Brazil, groups in situation of social vulnerability. Brazil had been evolving regarding the fight against endemic hunger, mainly between 2003 and 2014, when the country left the Hunger Map in global context through public policies carried out to combat this inhuman social problem, by giving opportunity to material equality. However, currently, socio-economic problems faced by Brazil are causing the country to return to the Hunger Map in global context. This research seeks to demonstrate whether Brazil, through affirmative actions and public policies, has been implementing an action agenda based on constitutional norms and regulations derived from international law treaties regarding the protection for the Human Right to appropriate feeding, succeeding in fighting hunger. By ratifying Human Rights protection Treaties in international context, Brazil is also compelled to protect and realise the Human Right to appropriate feeding through State legislative, administrative and jurisdictional activity by means of international cooperation policies. The Human Right to appropriate feeding must be protected and safeguarded, given our country’s reality of many contradictions and social differences. Public policies are necessary for the basic, social rights to be realized to individuals who, due to their inabilities, need to regain their freedom to practice their fundamental rights. The methodology utilized in this research was hypothetico-deductive and dialectic, working on historical evolution data, through analysis of governmental public policies, which reduced endemic hunger rates in Brazil to the present day. The developed issue is related to a regression in State benefits guaranteeing social and fundamental rights, compromising development data and consequently increasing social vulnerability statistics in our country, as a result of recent costs containment and investment retraction policies in social assistance, which are increasing food and nutritional insecurity rates. This research intends to demonstrate that Brazil will safeguard the constitutional and Human right to appropriate feeding through public policies and affirmative actions’ continuity directed at groups in situation of social vulnerability, as well as in international context, through cooperation mechanisms, dialogue and solidarity in legal activity, ensuring the Human Right to appropriate feeding and food security, also through control of conventionality
