RESUMO:

The present paper is ameid to the study of women in employment relations in the
perspective of the development of human rights, while facilitators of emancipation. For
that, the conception of patriarchal and slave ideologies was analyzed, which are
potential catalysts when the subject is facing the subject woman as object, kept their
respective peculiarities of perspective, and spread even more when they are expressed in
the interests of capitalism. In the course of the study, was analyzed the special
subjection of the woman – in what stands out from the man - in both the slave and
patriarchal views; the "place" presented to women in the world of work was analyzed,
with emphasis on domestic work as an embryo of subjection, to the repercussion on the
sexual division of labor, with evidence in Brazil and in the world. From this backdrop, it
was proposed the examination of how the handling of Labor Law itself, reflected in the
principle of worker protection, it was being harmful, by the compensation structure, to
the worker himself, and, in the case of the working woman, as protection enhanced by
patriarchal interests only confers the greatest marginality. Of this, situations were
identified to prove this examination, as in the case of bans on night work and unhealthy
work for women (without scientific foundation that considered it different from the
man), new legislative proposals such as homescooling, which indirectly determines the
return of the woman to the home, and the absence of protection from dismissal without
just cause and arbitrary as one of the main causes of harmful effects in the working
conditions of women. Faced with such conclusions, it was perceived that only the
correct management of the woman as a human, with human rights treatment, against
patriarchal and slave standards already absorbed. In this step, the identification of the
culture of Human Rights, with an analysis of two perspectives of women's approach to
employment relations, the first by real equality and the second by peripheral and
conditional access to maternity (when the principal is the unborn child and the child), is
able to propitiate said structural change of behavior in relation to women's labor
relations. At the end, with this, in view of the main obstacles to dealing with this
context, aspects that really require a new culture around working women, such as sexual
harassment, bullying, maternity discrimination, from the constitutional forecast,all
leading one to believe that without education to humanize all human, without
emancipation for human rights, only human will be those that the law, the woman is still
far from being a human in full.
