RESUMO:

The controversy over GM food is extensive. Several issues are raised and humanity is not yet ready to answer them, advances in biotechnology, such as genetic manipulation, are leaving the legal rules equidistant in this new announced world. Because they have changed their genetic composition in the laboratory, the use of GM food still needs further scientific analysis to the impact that would cause on the environment and human health effects. The size of the problem that is taking around the world indicates that in Brazil also, it will be necessary to struggle to preserve both ethical aspects and the legislation together with the scientific advances. The Federal Constitution of 1998 guarantees the preservation of diversity and integrity of the genetic heritage of the country. The theme is contemporary, fruitful, but it is necessary to recognize that it is quite complex and it has many aspects, therefore it what is proposed here is to discuss the safety of genetically modified food, once they have important  space in the scientific and legal environment in the view of the Brazilian Legislation, in particular the Law 11.105/205, also called the Law on Biosafety in addition to considerations contained in the Consumer Protection Code, with regard to information and food labeling. The methodology used in this work is theoretical in bibliographic forms, judicial and legislative, and the method chosen is the historical comparison, since it chronicles the evolution of GM foods and different doctrinal views. Hence the importance to resort to the legislation and jurisprudence of Biolaw and Bioethics, in order to apply and interpret the new agricultural border, because GM food is here, and it came to stay.
