RESUMO:
The present research is a longing that denotes the need for, increasingly, to seek in our system, mechanisms of guarantee, not only to the maintenance of the public policies focused on the rights of the State, since they are still deficient, but also to its progress, aiming at transforming the difficult Brazilian social reality, historically marked by the frequent violation of basic rights for the dignity of the human person. In this regard, it looks back to the protection afforded to social rights by the Principle of the prohibition of social retrogression, bringing, first, considerations about its emergence, concept and essential content, in the light of neoconstitutionalism, and its applicability. It then approaches the context of the economic crisis and the disciplinary legislation of the expenditure containment measures, in particular the provisions of the Fiscal Responsibility Law - LFR, a law that was born in a crisis scenario and for the crisis, aiming at public finance, whose application is intrinsically related to the effectiveness of social rights. Finally, it analyzes the real possibility of materializing fundamental social rights, given the instruments presented, demonstrating the need for validation of the Principle in question, in order to contribute to the improvement of the reality of the preservation and realization of these rights.
