RESUMO:

The aim of this work is to analyze the theory of the classical social contract in the light of Martha Nussbaum's theory of capabilities to question the possibility of inserting animals as possible citizens, since we share with them the same functions of citizenship as nationality, popular sovereignty and political agency, however, the condition of rationality and mutual advantage are impasses for the foundation of their rights. It is necessary, therefore, to rethink political theory at its origin, to enable answers to these questions. It is for this reason that, first of all, a political theory covering animals must also be considered rather than systematic elaboration of legislation. The creation of laws will not offer a solution to animal exploitation if the dogmatic theory that underlies the Constitution also corresponds to this yearning. Understanding that this work lends itself essentially to a philosophical exercise, without pretensions to find answers, but to show possible ways, we will analyze the importance of a more comprehensive political study, and in what way this implies in necessary changes to the Law, with a view to an application more democratic and less speciest. Finally, we will analyze the agency of animal rights due to the virtue of social justice.
