RESUMO:
The objective of the present paper was to cast a legal view over the personal data monetization scenario, aiming with this to suggest regulatory perspectives on these economic activities, with the desire to contribute on the right do privacy protection. To that intent, briefly exposed the evolution of the right to privacy, reaching the contemporary need of personal data protection and its inherent challenges. The paper inserted the right to privacy on information society, net society and cyberspace paradigms, contextualizing it and, in doing so, extracting a protective content able to safeguard this right in the face of this data protagonism scenario complexities. It aimed to suggest, from the analysis of the Brazilian related legal institutes and considering the previous theoretic constructs, regulatory guidances fit to approach the data monetization scenario. It managed to indicate certain directions, although general, abstract and timeless, that can auxiliate the State in this endeavour. It concluded that there is a need, in Brazil, of a specific data protection law and data protection authority, as well as the need of a risk-based regulation and in the “code is law” perspective.
