RESUMO:

The present work seeks to analyze the modeling legal framework of the Brazilian experience of implementing Smart Grids. The thematic relevance stems from the fact that since the second half of the 2000s, intelligent electricity grids have come to mean an important paradigmatic shift in the concept of energy matrix. Incorporating elements of technology and high flow of trade, it presents itself as an important element of the search for energy efficiency and sustainability of the sector in a global scenario. One of the characteristics of smart grids is to aggregate distributed generation in their matrix, which re-signifies the role of the consumer, assigning an active role throughout the process. In Brazil, as of Call No. 011/2010 of the National Electric Energy Agency, the subject was studied in more detail, and some regulatory measures have shaped the way for the implementation of the first pilot projects. However, issues inherent in policy-making that takes into account disparities resulting from the unequal urban training experience of the country persist for analysis. In this way the main objective of the investigation is to draw a correlation between the technological essence and the Brazilian legal framework, so that one can observe the filter that directs the experience to the attainment of the constitutional objectives. For this, the research focused on the bibliographical review, national and foreign, seeking the constant dialogue between doctrine and official statistics, being the methodological construction supported by the hypothetical-deductive and argumentative argumentative methods. In the development of the chapters, there is the observance of how the constitutional structure absorbs the right to energy, understanding its essence and symbolic implications. In addition, the identification of the right to energy with the right to the city denotes the twinning between the concepts of smart city and smart grid. From the correlation, we will investigate the implementation models in the US and in the European Union. Finally, there is a reflection on Brazilian regulation, pilot projects and hypothetical legal failures.
