RESUMO:

The main purpose of this work is to analyze how sustainable urban mobility and self-regulation of shared economy activities can enable the construction of smart cities in Brazil. Therefore, we intend to study in detail the current situation of the national transport system and the controversy surrounding the difficulty of democratic access of citizens to the constitutional right to move around. Consequently, the correlation of this aspect with access to the city and the feasible possibilities of correcting the distortions of the precarious current mobility will be discussed through the construction of smart cities and the progressive fomentation of the sharing economies. This way, the essentiality of technology will be addressed as an essential tool for the creation of smart cities, as well as delimitations on governance in the context of suggested transformations and the relationship between urban planning and the construction of sustainable urbanism. The implementation of this study will involve the application of the inductive method, through indirect research, with the accomplishment of a bibliographical review of the doctrine, analysis of constitutional and infraconstitutional legislation associated with the presentation of supporting data referring to the national situation that concerns to the structure and urban mobility. The deeper appreciation of the theme will allow the observation of entrepreneurship, in the case of the growth of the transport sector and the new collaborative and technological trends in expansion. Then, a case study focusing on the Uber application will be presented, with the purpose of bringing up to the discussion its characteristics, functioning, and the rejection of the category of taxi drivers before the exercise of their activity. Finally, there will be exposure of the hostile situation between taxi drivers and those accredited to the digital platform, especially with direct reference to the growth of shared economies. In this way, a table containing comparative information of these categories will be presented, containing relevant data about their main distinctions of operability and pricing. The debate will continue on the regulatory issue with the aim of discussing the infeasibility of state regulatory apparatus on shared economy activities. Finally, the theme of self-regulation will be defended, along with its application focused on collaborative initiatives, especially on Uber, with a further analysis of the Brazilian regulation against the regulation undertaken by Law 13.640/2018 for private and individual passenger transportation.
