RESUMO:

In a decision handed down by the Dispute Settlement Body of the World Trade Organization, by means of panels DS472 and DS497, it was established that the Inovar-Auto Program, among other measures of investment adopted by Brazil, is incompatible with the Agreement on Trade-Related Investment Measures (TRIMS Agreement). Thus, the present study seeks to analyze the Brazilian government's alternatives to the decision regarding the inconsistencies of the Inovar-Auto Program to the TRIMS Agreement, which demonstrates the need to adapt the Brazilian rules to agreements signed within the framework of the WTO. The work is based on bibliographic research in the field of Economics, Constitutional Law, International Law and International Economic Law and judged earlier in the scope of the WTO Dispute Settlement System. The work is divided into two parts. The first part outlines the main objectives and characteristics and the context that led to the elaboration of the TRIMS Agreement and the Inovar-Auto Program, presenting its normative aspects and doctrinal analyzes related to them. The second part addresses the panel ruling, the procedural aspects of the controversies held within the WTO and the alternatives to the Brazilian government. It follows that the appropriate solution to Brazil is to comply with the recommendations of the judges, in accordance with the principle of good faith and pacta sunt servanda and to avoid the application of sanctions by the European Union and Japan, for through the suspension of concessions, which would cause economic loss to the country.
