RESUMO:

The present dissertation aims to analyze the administrative contracts established with private partners for the execution of health services within the Health Unic System and the respective control modalities over public administration. The deductive method was chosen to study the appropriate legislation to this subject and on the bibliographic research that supports this discussion. At first, it was presented a philosophic perspective with the insertion of social right to health care framed by society in a hypothetical initial position. Health care is exposed as a condition for citizens to be free and equal. Subsequently, considerations were made contemplating rights to health care within the brazilian juridical order and the institutions involved such as the National Supplementary Health Agency and the Brazilian Hospital Services Company. Thereby, the forms of public contracting processes that were more frequently on the Municipality of Natal/RN are analyzed and the management executed over the activity to benefit the efficiency of adjustments. In conclusion, it was presented that the ideals of public health care will be strengthen by a set of measures, as a multifactorial response of society, public administrators and of the legislative and judiciary in order to develop this sector.
