RESUMO:

It is intended to (re) construct a theory of judicial decision, adequate to the procedural context of a current Brazilian democratic constitutional jurisdiction, which entails more than rational instrumentalities for the justifying procedure of the decision-making, encompassing the very trajectory of conviction formation the evaluation of the other possible decisions and their respective consequences, the sizing of their scope and, in particular, the confrontation of these issues with judicial precedents, the importance of which is revealed in the new procedural code civil. It seeks to understand the judicial decision as essential to the understanding of the legal phenomenon itself, as a result of the influence of all actors who are directly or indirectly involved in its elaboration, such as the parties and their lawyers, the courts and their jurisprudence, the academy and its doctrines, and also organized civil society. It permeates the recognition of the need for the legal legitimization of the judicial decision for the realization of a fair and democratic process, and it is necessary to rethink the system of current application of a model of a system of precedents badly deceived for the Brazilian process. Finally, it proposes a critical examination of the construction of legal security and the protection of the predictability and reliability of the current Civil Procedure Code resting on the verticalisation of the judicial decision and on the subjection of the magistrate to judicial precedents.
