RESUMO:

Public expenditure on personnel is a subject that has recently gained relevance due to the difficulty that the federated entities, especially in the States, who are finding it difficult to fulfill their payment. It occurs that the legal system, starting with the Federal Constitution, determines that the expansion of that type of spending must have strategic planning that determines harmony with the budget laws. In addition, the regulative legislation, governed by supplementary law no. 101/2000, also known as the fiscal responsibility law, indexes the growth of public expenditure with personnel to the net current revenue of political entities with the objective of providing the sustainable growth of that type of expenditure. It also establishes a specific control system that legitimates the compulsory exemption to guarantee the costing of the personnel sheet provided in art. 169 of the Federal Constitution of civil servants commissioned or effective. Stable or not. The growth of public expenditure on personnel must also have legal relevance with the principles that structure the exercise of the administrative function. In addition, the Democratic State of Law determines that the acts of public administration pass through the external control, which encompasses, in the parameters established by this research, the legislative function of Power, society and the courts of accounts. The external control of remuneration policy in the public service involves from the consideration of the matter in the justice and citizenship committees and budget, until the public hearings where not only the public servants and / or representative unions can participate in the discussions, but also the whole with access to accounting reports with emphasis on the fiscal management report, should participate in the decision-making process related to the expansion of public expenditure with personnel. The current legal system also grants constitutional jurisdiction to the courts of auditors to follow up the budget execution, observing the parameters established by the legislation in force. To do so, they must issue alert terms when the limit on personnel expenses reaches 90% of the allowable amount, as well as issuing prior opinions annually on the administration of the Treasury, which must be submitted to Parliament for consideration. The public expenditure with personnel has specific limits in relation to the federated entities, which are established by the Fiscal Responsibility Law and this research has as a methodological cut the control of the public expenditure with personnel in the scope of the executive function of the State Power.
