RESUMO:
This work analyzes the need for the subtraction of justice in the capitalist state in order to carry out the study concerning the idea of Justice in the Communist Hypothesis, starting from radical post-Marxism, mainly iek and Badiou studies, and also through an illustration, carries a dialectical study in parallel of the motif of the tale The Man Whose Ear has Grown, by Ignacio de Loyola Brandão. Based on these, the dialectical materialist method was used, its bibliographic reference permeating the legal researches and philosophical studies of Law critique, specifically, the role of Justice to the State, as well as that of constitutionalism in the defense of Capital through the strategy of Social Pacification. The post-Marxist theoretical-critical delimitation was used to define Communism in this current contemporary darkness, to debate the need to think over a radical left-wing project associated with the (in)flow of the Idea of Justice as an Idea of Truth, starting from the apprehensions of the Real, the Symbolic and the Imaginary together, understanding in what level the Great Other operates in Capitalism, but also how it is possible to take place through Communism, considering that even in this collective space it can be experienced the fair and the unjust, since the Adikia, as a ditch between Techne and Dike, occurs in the field of the Symbolic in the Real, through its effects, because when isolated it is an impossibility, and, therefore, only verifiable from its outcomes.
