RESUMO:
This work presents an analysis of investment trusts under Brazilian regulations. The incidence of the Brazilian consumer protection system to the relationship between settlor and trustee is assessed. Text addresses the Economic Order, defined by the Brazilian Constitution, state regulation, financial market and consumer protection. Following, it is presented a brief history of investment funds and the legal nature of investment funds is discussed. Next, administrative regulation aspects are discussed to place the funds in the Brazilian National Financial System. Subsequently, the relationship between settlor and trustee in the administrative regulation of the Brazilian Financial System is analyzed. The possibility of applying the Consumer Protection Law to the relationship between settlor and trustee is recognized, provided that the first meets the requirements to be characterized as a consumer in Brazilian consumer regulation. The existence of a dialogue between the normative sources of the Brazilian Financial System and Consumer Protection is admitted. After that, text aims to outlinethe duties and responsibility of the trustee under the rules of the Brazilian consumer protection system: duty of loyalty, duty of information and responsibility of the trustee. Research method consisted in the review of the scientific literature regarding the investment trusts and the analysis of Brazilian constitutional and federal regulations as well. Court precedents related to the subject were also brought the discussion.
