RESUMO:

The sugar and alcohol industry in Brazil is experiencing cycles of rise and decline, so that it is not possible for the investor to contribute large resources to this market, in view of the fluctuation of public policies related to the fuel sector, especially when adopted in the A subsidy model to the price of fossil fuels, damaging the biofuel that has a technical ceiling of efficiency in terms of considering its own chemical composition. Even though due recognition is given to the regulatory attempts to print measures to contain the bleeding that the sugar and ethanol market faces, notably, the advance of the regulatory framework for ethanol, with the change of percentages of anhydrous in gasoline, the formation of regulatory stock and The tax incentives in the area, the wound is still far from being stagnant and deserves a sharp look on the subject. Under the constitutional aspect, the legal feasibility of a stock control in the fuel market, its consequences, parameters and limits must be investigated, without first evaluating the harmfulness of the consumer and the environment, as well as the economic Evidenced in each attempt to regulate the market. In this paper, we also analyze the dynamics of the ethanol market as a fuel included in the National Biofuels Policy and the effective functioning of the regulatory rules regarding the creation of regulatory stock and control over the fuel producing agent, verifying the impacts Of the policy on distribution activity, relating to the effects to the consumer, under the perspective of the Economic Order inscribed in the Federal Constitution of 1988, as well as the legal limits of economic power and market regulation.
