RESUMO:

Equal rights between women and men, while ensured by national and international rules, have not been fully achieved. In the labor market, women have lower wages, higher unemployment, greater occupation in the informal market, less representation in higher hierarchical levels and greater work day in unpaid work. The research aimed to answer two central questions: 1) Is there any current determining factor or the gender inequalities at work are a reflection of a historical past? 2) Is the legislation in force in Brazil sufficient to ensure the protection of the women's labor market? Using the  technique of documentary prospecting in national and international norms (ratified or not) and the qualitative and quantitative empirical study of the discourse method of the collective subject in samples of questionnaires applied, the obtained results show that: a) the unequal distribution of family responsibilities interferes negatively in the professional women’s career; b) labor standards for reconciling work and family life of workers of both sexes bring about improvements in gender equality at work; c) the Brazilian legislation is insufficient to guarantee the protection of the labor market of women; d) although Brazil has not ratified ILO Conventions nº 156, on Equal Treatment for Workers and Workers with Responsibilities; And 183, on the Protection of Maternity (Revista), international soft law standards can be used as an integrative source of the absence of a constitutional guarantee regulatory rule (article 7, XX, CF); e) greater gender equality has a positive impact on economic growth; f) equality in the age and time of retirement contribution between women and men, before effective family co-responsibility for unpaid care work, causes serious legal and social distortions.
