RESUMO:

The legal issues concerning to older people gain special emphasis in a national scenario marked by an accelerated process of ageing population. Among the countless violations that those people are victims, is highlighted the defilement of their individual freedom by suppressing their own wills. The research developed throughout this study has the objective of examine the possibility of limitation of the lucid elderly´s right to individual freedom, especially when the preservation of that freedom endangers rights of higher stature belonging to the same owner. It adopts as research methodology the case study and bibliographical research, including, in this last one, the exploration of doctrine, legislation and judicial decisions. The study presents a historical route of the recognition of the right to individual freedom and underscores its positivation in the 1988 Federal Constitution. It stresses the non-absolute nature of the right to freedom. It discusses whether the individual is required to exercise a fundamental right. It situates the autonomy as a face of the right to freedom. It emphasizes that the senescence is not unfolds, by itself, as a legal incapacity. It analyzes the legislative changes occurred in 2015, concerning to the protection of individual autonomy. It examines the feasibility of ensuring protection for the elderly, saving, at the same time, their autonomy. It clarifies the limits to the work of the public prosecutor`s office, when facing a lucid elderly person in risk situation. It undertakes a case study in which the judiciary recognized that the freedom of a lucid elderly should be preserved, even if that fact could result in the death of the senior. From the analysis of the cast of primary goods of John Rawls and the investigation of rights part of the existential minimum, outlines new concept - the essential minimum - composed by the individual freedoms. It distinguishes minimum essential from essential core of fundamental rights and explains the new concept applicability environment. It arrives at the conclusion of the usefulness of adopting minimum essential as parameter for case resolution which involves only one holder rights, highlighting the relevance of its use in the protection of the elderly people`s autonomy.
