SUMMARY:

This dissertation analyzes the judicialization of access to antineoplastic drugs in the state of Rio Grande do Norte as a complex social and legal phenomenon that arises from the tension between the constitutional right to health and the challenges of public administration, which generates inequities and significant budgetary impacts. The general objective of the study is to analyze the judicialization of health from a reflective perspective, focusing on lawsuits that demand antineoplastic drugs, the profile and mortality of the plaintiffs in these actions, as well as the financial perspective of these judicialized medications in the state of Rio Grande do Norte between 2013 and 2020. The methodology is structured in three complementary stages, presented as a collection of articles: a theoretical essay that reflects on the phenomenon based on the State Derivation debate; a descriptive and retrospective cohort study that analyzes 868 lawsuits regarding their sociodemographic, legal, medical-sanitary, and financial aspects; and a descriptive study that characterizes cancer mortality in this cohort by cross-referencing data with the Mortality Information System (SIM) up to 2023. The partial results, presented in articles, demonstrate that judicialization, while representing a struggle for rights, functions as a mechanism for the reproduction and accumulation of capital by the pharmaceutical industry, which highlights the weaknesses of the Unified Health System (SUS) in the face of judicial demands and the structural problems of the State. The concluding remarks from the analysis of the results obtained so far indicate that the absence of clear public policies for financing antineoplastic drugs reinforces inequalities and Brazil's subordination to the global logic of capital, making it essential to deepen the understanding of health judicialization to strengthen a more equitable and rational oncology policy.
