SUMMARY:

This dissertation investigates whether gender-based violence in Brazil, based on an analysis of the figures reported in 2025, constitutes a structural dispute capable of characterizing an Unconventional State of Affairs. The relevance of this research stems from the high rates of violence recorded against women in the past year, which reached levels never before observed. To this end, the study adopts a qualitative approach, as it will analyze social facts in order to understand gender-based violence as a structural problem. Furthermore, regarding its objectives, the research is descriptive, since it will examine the variables associated with the increase in cases of gender-based violence in Brazil and their correlation with the characterization of an Unconventional State of Affairs. Moreover, it is explanatory insofar as it seeks to identify the causes behind these elevated figures, as well as exploratory, given its aim of confirming or refuting the existence of an Unconventional State of Affairs in Brazil with respect to violence against women. Thus, the study seeks to demonstrate how the historical roots of patriarchal values constitute a material premise that gives rise to structurally rooted gender-based violence, leading not only to an Unconstitutional State of Affairs but also to an Unconventional State of Affairs. The latter is understood as a decision-making technique that may be employed by the Inter-American Court of Human Rights, through the exercise of conventionality control, to monitor and contribute to the restoration of a state of normality for women in Brazil.
