SUMMARY:

Given the profound transformations that technological advancement has brought about in social, political, and economic relations, Public Administration has sought to adapt to the contemporary context, proposing modifications in the delivery of public services in order to meet the fundamental principles of the Democratic Rule of Law and protect fundamental rights. In this sense, although Brazil has advanced in the process of digital transformation of public management and in the regulation of rights of access to information and protection of personal data, some challenges still persist, such as promoting transparency without compromising personal data, coupled with the development of Digital Government in the country. Therefore, the question arises: how can Brazilian Digital Government promote administrative modernization, efficiency, and the expansion of democratic participation without compromising the fundamental rights of access to information and data protection? Thus, the general objective of this research is to examine the compatibility between Digital Government and the rights of access to information and data protection within the framework of the Democratic Rule of Law and in the context of digital transformations. Specifically, it proposes to verify the compatibility of the Democratic Rule of Law with digital transformations. This research aims to analyze the implementation of Digital Government in Brazil, focusing on the actions of the Federal Government in conjunction with the public institutions of the Brazilian Federal Revenue Service (RFB) and the Federal Data Processing Service (Serpro); and to identify how the Access to Information Law (LAI) and the General Data Protection Law (LGPD) contribute to the realization of Digital Government. To this end, the research was developed using a predominantly bibliographic procedural technique, analyzing publications in the areas of Constitutional Law, Administrative Law, and Digital Government, consulted through the Scielo platform, the Capes Periodicals Portal, and institutional repositories. Documentary techniques were also used, accessing regulations, reviews from international organizations, public records, and journalistic publications. The approach is both qualitative and quantitative, combining an understanding of norms, principles, and doctrinal interpretations with the analysis of secondary data published by the Federal Government and international organizations. The methodological approach is deductive, starting from the foundations of the Democratic Rule of Law and fundamental rights to examine Digital Government, its proposals, challenges, and perspectives. The objectives of the dissertation are descriptive and explanatory, as they focus on identifying, describing, observing, and recording the paradigm of Digital Government and its aspects. Finally, the research is justified by the increasing incorporation of digital technologies in Public Administration and daily life, which modifies traditional relationships and requires regulatory activities as part of the state strategy. These transformations present positive and negative aspects for the Democratic Rule of Law, society, and the economy, demanding critical and constructive analysis to ensure fundamental rights and popular sovereignty. Furthermore, the research engages with Research Line 1 of the Postgraduate Program in Law at UFRN, Constitution, Economic Regulation and Development, linking the constitutional dimension as a foundation for administrative efficiency, economic regulation as an instrument for protecting rights in the face of the growing protagonism of private actors, and development as a driver of institutional and social improvements in the most diverse areas.
