SUMMARY:

This study analyzes the participation of municipalities in Brazil’s Unified Public Secu- rity System, focusing on prevention as a means of ensuring the fundamental right to public security. It revisits historical aspects of municipal autonomy, identifies major threats, and addresses the role of municipalities in this field. It points to a problem arising from the application of a literal interpretation of Article 144, §8, of the 1988 Constitution, as opposed to the systemic interpretation adopted by the Federal Su- preme Court (STF) in cases examining Law No. 13,022 of 2014 and Law No. 13,675 of 2018. It draws a comparison between the Unified Health System (SUS) and the Public Security System within the constitutional text, indicating points of convergence and divergence. It discusses the case of the Maria da Penha Patrol Program in Natal as an example of the potential of municipal action in prevention. It examines Consti- tutional Amendment Proposal (PEC) No. 18 of 2025 and offers a critical assessment of it. Its central question concerns the legitimate place municipalities should occupy within the context of public security. The answer is pursued methodologically through a literature review and documentary analysis. It identifies as its main findings the ne- ed to place prevention at the forefront of the public security system and to assign municipalities a clear role in this function.
