SUMMARY:

This dissertation investigates the existence of potential regulatory gaps within the wind energy sector in the state of Rio Grande do Norte, Brazil, particularly concerning the theme of energy efficiency. Emphasis is placed on the analysis of data related to the sector’s expansion over the past ten years. In Rio Grande do Norte, the proliferation of wind energy projects has occurred alongside structural challenges that hinder the fair distribution of the benefits generated. The research is guided by the following problem statement: do regulatory gaps within the domain of wind energy affect energy efficiency in the state of Rio Grande do Norte? It is preliminarily observed that there is a scarcity of legal approaches that correlate the socio-economic and environmental effects of wind energy activities with the applicable legal frameworks—particularly considering Sustainable Development Goals Nos. 7 and 10 of the 2030 Agenda of the United Nations. It may further be posited that the regulatory void undermines both the sector’s performance and the well-being of affected communities. The objective of this research is to determine whether the regulatory shortcomings of the Potiguar wind energy sector have repercussions on energy efficiency and on the fundamental rights of the impacted populations. The study is of an applied nature, theoretically grounded, and adopts a deductive method, beginning with general normative analyses and progressing toward the specificities of the Potiguar wind energy context. The research employs a qualitative-quantitative approach, combining conceptual analysis with empirical data. The findings reveal a significant disjunction between the sector’s economic growth and its tangible impacts on local communities, characterized by normative asymmetries, the absence of effective mechanisms for social compensation, and gaps in oversight and corporate transparency. In this context, it is imperative to enhance regulatory frameworks to ensure, in an equitable manner, pluralistic standards of energy efficiency, while safeguarding the social, economic, and cultural rights of affected populations and fostering sustainable development. The aim is to promote a more balanced relationship between economic growth and socio-environmental justice.
