SUMMARY:

Basic sanitation in Brazil faces significant barriers to its implementation, and its absence negatively affects quality of life, health, the environment, housing, and urban living. The lack of these services facilitates the spread of diseases and environmental imbalance, especially due to the improper disposal and inefficient treatment of water and sewage. This study highlights the importance of recognizing sanitation as a fundamental right and the need for public policies directed toward the population, in line with Law Nº. 14.026/2020, which amended Law Nº. 11.445/2007 by reinforcing access to this essential public service, with constitutional underpinnings. Sanitation is thus understood as intrinsically linked to health, salubrity, and quality of life, comprising four main pillars: solid waste, urban drainage, sewage, and drinking water — the latter two being the focus of this research. Given that a significant portion of the population still lacks access to these services, the implementation of effective public policies is essential to reduce disease incidence and levels and to ensure a minimum standard of living, which is a duty of the State in guaranteeing human dignity. The research also analyzes the consequences of inequality in access to sanitation, framing it as a critical issue open to broad debate within the social and legal spheres of public policy, with direct implications for the realization and enjoyment of this right. Additionally, the study addresses environmental concerns related to sanitation, the inequalities that may arise, and how the lack of access prevents the realization of dignity within the urban context. Through a literature review and the observation of selected localities in Brazil, the study seeks to reinforce the importance of recognizing sanitation as a fundamental right. The topic is approached through the deductive method, exploring its inclusion among constitutionally protected rights, as proposed in Constitutional Amendment Proposal Nº. 2/2016. The work is also directed toward legal professionals, policymakers, and urban planners. It further examines the new regulatory framework for water and sewage services introduced by the 2020 legislation. Inequities in the provision of sanitation services exacerbate socio-political issues and marginalize segments of the population. The study also incorporates the 2030 UN Agenda and the Sustainable Development Goals, offering relevant contributions to the theme. The central issue addressed is the challenge of achieving universal access to sanitation services and the recognition of sanitation as a social right, aiming to promote sustainable and dignified cities. In this regard, sustainable cities and popular participation can guide urban management and the reduction of inequalities. This research is justified by its relevance as a parameter for the protection of citizens, the environment, and urban areas in light of disparities in access and service maintenance. The general objective is to understand the evolution of sanitation and the development of sustainable and smart cities as a means to promote quality living conditions and the recognition of sanitation as a fundamental social right, encompassing issues such as health, sustainability, public-private partnerships, and solutions for smart city development. Methodologically, the research is of a theoretical nature, aiming to foster scientific knowledge in the field of sanitation and smart cities, with a qualitative-quantitative approach and an explanatory-descriptive purpose. Technical procedures include bibliographic review of books, articles, and journals, as well as documentary and case law research through government websites, news outlets, and legislation.
