SUMMARY:

The legalization of civil marriage between people of the same sex has been demanded
worldwide for decades, and the struggle of the LGBT+ (Lesbian, Gay, Bisexual,
Transgender) movement in the 21st century has intensified to the point of achieving this
right in several Western countries. In Brazil, in 2011, the Federal Supreme Court (STF)
ruled that civil same-sex marriage was lawful, and in 2013, a resolution by the National
Council of Justice reiterated this position, prohibiting registry offices from refusing to
marry people of the same sex. In 2023, however, Bill 5167/2009, which aims to ban same-
sex marriage, was reintroduced. This is technically still possible because a law that has
been voted on and sanctioned necessarily overrides a decision by the STF. In response to
the bill that was taken off the shelf, Bill 580/2007, which aims to permanently legalize
same-sex marriage, was also reintroduced. The main objective of this research is to shed
light on the current state of legislative discourse on same-sex marriage, which has

resurfaced in the Chamber of Deputies thanks to the new vote and debate on the
aforementioned bills. To this end, we analyze the reports of federal deputies Pastor Eurico
and Érika Hilton, who were rapporteurs for the bills, that is, they presented arguments
defending their positions on the agenda addressed in the respective bill. The questions we
aim to answer are: (a) How is the discourse on same-sex marriage characterized in the
opinion of rapporteur Deputy Erika Hilton on Bill 580/2007? (b) How is the discourse on
same-sex marriage characterized in the opinion of rapporteur Pastor Eurico on Bill
5167/2009? (c) What dialogic relationships can be identified between the two reports? The
analysis developed is based on the Bakhtinian perspective of discourse analysis, that is, it
falls within the field of Dialogic Discourse Analysis and is qualitative in nature. This means
that the main theoretical basis of this research is the works of Bakhtin (2009, 2022), and
Volóchinov (2017) on language, and, additionally, the works of Brait (2008), Faraco
(2019), Ponzio (2008), and Sobral (2009), with a special focus on the concepts of
dialogism, social voices, the non-neutrality of discourse, and responsible speech. Four
categories of analysis were found to exemplify the dialogical aspects of each report. The
first category of analysis developed already makes it possible to preliminarily identify the
current polarization between discourses supporting and rejecting same-sex unions,
represented in the arguments used by the aforementioned congressmen. The dialogical
relationships found between the two reports reveal a dialogism centered on almost complete
oppositions of views on same-sex marriage.
