ACCESS TO JUSTICE FOR THE MEDICINAL USE OF MARIJUANA IN THE STATE OF RIO GRANDE DO NORTE
Keywords: marijuana; medicinal use; access to justice.
The main aim of this research is to understand the strategies for legal access to the medicinal use of marijuana in the state of Rio Grande do Norte. It aims to analyze the narrative disputes present in the processes of legitimizing the therapeutic use of marijuana and the resources used to obtain the medicine, such as cannabis associations, where patients connect with prescribing doctors, lawyers, and other professionals who can assist in this process. The responses obtained at the institutional level will also be analyzed, seeking to understand the moralities that underpin legal positions. To this end, in addition to ethnographic research and semi-structured interviews, documentary analysis of users’ procedural records and preventive habeas corpus will be used. The aim is to understand how citizens who actively seek the right to health (Policarpo, 2019) deal in practice with the prohibition of marijuana and the small margin recently granted to the medicinal use of the plant.
