SUMMARY:

The present research aims at analyzing the increase of the female incarceration in Rio Grande do Norte (RN), apprehending the mediations between brazilian socio-historical determinants, the current criminal policy at the country and the patriarchal gender relations. It will be assumed that the incarceration in Brazil found its roots in socio-historical determinants that dates back its social-economic formation and the social relations marked by authoritarianism, racism and the patriarchy. Therefore, it delimits the research proposition, questioning how today the set of structural mediations of the Brazilian socio-historical formation, the patriarchal gender relations and objectivization of the current criminal policy affects the increase of female incarceration, in particular in RN. In this regard, the time frame for the analysis in the present study is delimited between 2006 and 2020. To answer the question, it is intended to analyze the existing mediation between the socio-historical determinants of the incarceration in Brazil, the patriarchal gender relations and the current criminal policy to the imprisonment of women, in a way that it elucidates the increase of the incarceration of this group in RN. In this regard, it will be done a bibliographic research about the brazilian socio-historical formation; the ontology of social being; the marxist criticism of law and the State; the criminal policy, incarceration and critical criminology; the patriarchal gender relation and its mediations with the justice system, situating the phenomenon of female incarceration in Brazil in the current ultraneoliberal context. There will also be a documentary research, in which there will be analyzed data reported semi-annually by the Ministry of Justice through the National Penitentiary Department – DEPEN – and its database, the Information System of National Penitentiary Department – SISDEPEN. The information is available in the form of Analytical Reports (Summary tables) and infographics. There will be particularly analyzed information related to the amount of prison population between 2006 and 2020, and, inside these, the amount of women, with the help of a script that systematizes the following data: amount of female prisoners per regime in RN, which regime (closed, semi-open and open) had larger quantitative variation; criminal typification; race/ethnicity per regime and criminal typification; social class; scholarity. In order to articulate the analysis of these data, it is intended to do a deepening about the current criminal legislation, as well as its modifications and collate the subsides of the analyzes of social relations. Thus, it is believed that it will be possible to analyze the existing relation between the social production/reproduction and the phenomenon of incarceration in Brazil and its particularities in RN, as well as the current criminal policy in Brazil and its mediations with the phenomenon of incarceration and, in particular, the increase of the incarceration of women in RN and apprehend the existing mediations between the patriarchal gender relations and female incarceration. The Historical and Dialectical Materialism is adopted as a method of analysis for identifying in it the instruments that make possible to elucidate, in the set of historical processes of female incarceration in Brazil and its more concrets determinants, without disconnecting it from the organic whole that integrates
