This study presents the problematic of the effectiveness of the rights of adolescents who committed an infraction based on an evaluation of the socio-educational process in municipalities located in the Agreste Potiguar region. We aim to build this evaluation by presenting the follow-up flow of socio-educational measures in an open means in the cities of Boa Saúde, Serra Caiada and Sítio Novo, based on the normative analysis that predicts how the service of socio-educational measures in open means should be operationalized, using the following evaluation indicators: follow-up of the socio-educational process; development of the Municipal Social Assistance Plan; intersectoriality; the importance of family and society in the socio-educational process; and the conception of the adolescent as subject of rights. Our study is an analysis under a qualitative and quantitative theoretical-methodological approach, and the way to know the object and construct the reflections was made through a bibliographical review regarding the process of construction of the rights of children and adolescents, where the categories State and public policies stand out; quantitative data regarding the imputation of socio-educational measures in an open means in the analyzed region, from 2015 to 2017, provided by the Vara Única de Justiça da Comarca de Tangará/RN; as well as semi-structured interviews with the professionals who work in the municipal services that meet the demand for follow-up of the socio-educational process in an open means. From our studies it was possible to verify that the historical struggle for the realization of the rights of children and adolescents is permeated by an intense correlation of forces that can be identified both in the palliative intervention of the State in this segment and in the ideas disseminated in the imaginary which sometimes reiterate labeling and criminalizing conceptions of the segment in question. In addition, it was possible to identify the impossibility of effecting the condition of subject of rights, conferred on the adolescent, in reality analyzed, since the process of socio-educational accompaniment, destined to the accountability for the practice of an infraction with the guarantee of rights, does not present the minimum structure in the regulations, the articulation between public policies is practically non-existent and the conception of responsibility with socio-educational character is still confused with the idea of punishment.
