SUMMARY:

This dissertation is an ethnographic analysis of the judicial process regarding the demarcation of the Limão Verde Indigenous Land, through the unraveling of procedural documents in an effort to translate its forms of construction. Seen as ethnographic pieces, the judicial decisions, the testimonies existing in the process and the relevant documents in the present study are understood as a whole and in the historical, scientific, anthropological and political context, bringing up authors of the documents that are interconnected under different conditions and uneven. This is a judicial process that begins at the first instance of Federal Justice in Campo Grande / MS and reaches the Supreme Federal Court in Brasília / DF. This process is registered and incorporated into the legal procedures and territorial disputes historically faced by the Terena people. Containing negotiations and statements by authorities, the analyzed documents bring the transformations of the legal categories and anthropological conceptions with the applicability of the Marco Temporal legal thesis. The analytical path followed in this work is based on documents ranging from the initial petition presented in the Federal Court to the decision of last resort in the Second Panel of the Supreme Court, circumscribing issues related to the concept of traditional indigenous occupation. Here, law is also understood as a practice of procedural rites that lead to the constitution of a legal truth conflict situations printed in these documents, in which legal proceedings are also an important complex relational field for the discussion of how institutions exercise socially its dominance over individuals and their group.
