SUMMARY:

This research investigates the meanings that guide the institutional praxis of the National Adoption System (SNA) regarding racial selectivity in Brazil. Starting from the statistical finding that the prolonged stay of Black and mixed-race children and adolescents (pretos e pardos) in foster care institutions does not reflect isolated subjective choices of prospective parents, the study problematizes this phenomenon as a symptom of structural racism, prejudice of mark (preconceito de marca), and the pact of whiteness, whose roots trace back to the incomplete abolition of slavery and the historical criminalization of poverty. Grounded in Historical-Dialectical Materialism (HDM) and Socio-Historical Psychology, the research articulates Lukács' ontology of social being and Vygotsky's mediation theory to conceptualize the State's normative and documentary formulation not as a neutral rite, but as a secondary teleological position. The general objective is to understand how conceptions about race, family, and adoption materialize, are denied, or are challenged in the institutional discourses of the Justice System. The methodological design consists of Critical Documentary Research, adopting as its analytical corpus the open demographic microdata from the SNA alongside the normative guidelines, resolutions, and pedagogical preparation booklets formulated by the National Council of Justice (CNJ). Data analysis will be conducted using the Nuclei of Signification (Aguiar & Ozella), aiming to go beyond the technical appearance of the legal text to apprehend the ideological contradictions, silences, and latent zones of meaning in the State's discourse. It is expected to reveal whether the Judiciary's current guidelines regarding adoption operate as vectors of anti-racist transformation, challenging society, or if they reiterate reification and bureaucratic alienation, thereby providing robust critical insights for the structural transformation of public adoption policies in the country.
