PUBLIC TRANSPARENCY, ACCESS TO INFORMATION AND THE RIGHT TO PRIVACY: a case study on UFRN's open data policy.

Subjects that are related to public transparency, access to information and data, fight against corruption and social control, personal data protection and privacy gained value after promulgation of the Brazillian Federal Constitution of 1988. Added to that, and impelled by the development of information and communication technology (ICTs), brazillian state has formulated many regulation, laws and policies in order to satisfy this new exigency of society. In this scenario, we could mention the law of access to information (LAI) and the general law of data protection (LGPD), besides the national policy of open data, which is a initiative of the federal government. Observed the institutional field, there are the Open Data Plan (PDA) of the Federal University of Rio Grande do Norte (UFRN). In this sense, this research intents to analyse how the the Open Data Plan developed by UFRN relates to LAI and LGPD. The objective of this work is examine the accordance of PDA to those two mentioned laws, and, suggest, in order to achieve a better conformity to the law, an structure to improve the plan. The literature review presents the subjects related to public transparency, access to informatiom, privacy rights, data protection and open data policies with focus in LAI, LGPD and the mentioned PDA. The methodology of this research has qualitative nature, with exploratory objectives, and it is developed from a monographic method because it is a case study. The population in this research is compound by the comission responsible by the update of PDA in UFRN and the sample will be by census. As data gathering, it will be use a documental research and semi-structured interviews. The data analisys will take place through thematic analisys. As result as this research, we expect to build improvement tools and resources to be used in the updating process of the PDA, in order to achieve a better fit of the plan with the studied law.
