SUMMARY:

The use of Cannabis in health treatments gained prominence starting in 2014, through a public complaint made by patients and their families. This complex scenario was built from tensions and stigmas associated with marijuana as a fluid substance. Because of this, institutions such as the National Health Surveillance Agency (Anvisa), the Federal Council of Medicine (CFM), the National Congress, and the Federal Supreme Court (STF) became key players in the debate about the regulatory status of Cannabis and its derivatives, building a process of co-production. Thus, the objective of this thesis was to investigate the regulatory processes surrounding Cannabis as a health technology. From a qualitative approach, procedural documents produced by the institutions were analyzed, including technical notes, bills, and resolutions, as well as documentation artifacts such as public hearings and plenaries, focusing on the discussion about the therapeutic use of Cannabis and its derivatives. The analysis of these materials, including a survey of journalistic articles, was performed in a qualitative analysis program, Atlas.ti, through data coding. The results show how the arguments raised in documents and hearings go beyond an objective technical and scientific discussion, constructing regulatory distinctions that emerge in spaces of negotiation and dispute, considering broader processes involving stigmas, moralities, and control mechanisms. The distinctions between drugs, products, medicines, patients, and users are not neutral nomenclatures, but co-created categories that promote practical implications in access to Cannabis-derived substances. The regulatory distinctions and the hierarchy among groups of specialists reveal how the measures adopted so far are transitory and precarious and do not guarantee effective access to health treatment. The data collected show how public health and public safety are constructed as fields of dispute, where perceptions of risk and moralities are managed, revealing a co-production between science, politics, and the making of technologies. In this co-production process, what stands out is how institutional decisions, based on Science and its products, impact the daily lives of patients.
