SUMMARY:

This thesis focuses on four contemporary issues related to adolescents in socio-educational measures: the connection between the mechanisms of penal management of misery and the development of neoliberalism in Brazil; the relationship between adolescents in socio-educational measures and criminal groups called factions; the prohibitionist drug policy as a fundamental axis of the process of criminalization of poverty; and the limits and possibilities offered by the socio-educational measures depriving of liberty, analyzing how it can contribute to the creation of instruments that make possible the rupture with the infraction trajectory. As preliminary results, we highlight the role played by Law nº 11.343/2006 in the incarceration of adolescents and adults, which is ineffective concerning its declared objectives - that is, to reduce the consumption, trade, and circulation of illicit substances - and effective in undeclared functions, such as serving as an instrument for the criminalization and summary execution of individuals who occupy the fringes of society. Regarding the relationship between adolescents who are serving a socio-educational internment measure and criminal factions, the development of a qualitative investigation in two socio-educational units in Rio Grande do Norte allowed the construction of three typical-ideal models to understand the phenomenon: the discursive binding, territorial binding, and effective binding. Furthermore, we conclude that, although there is an effort on the part of the socio-educational system to consider pedagogical aspects and not just punitive-repressive aspects in its operation, it is anchored in a dead-end: aiming to adjust the deviant without considering that the deviant and the deviation are products of the social relations in which the subject is inserted. Thus, as much as the socio-educational system assumes, on a theoretical level, a progressive posture, it continues to function in a similar way to the set of other penal policies, that is, as a deposit of miserable people.
