SUMMARY:

The present study aims to analyze the relationship between the environment and forced displacements. The migratory phenomenon in general involves social and economic demands. In the context of forced migrations – where expulsion from their place of origin occurs – the vulnerability is even greater and involves these individuals in a crisis scenario (MYERS, 2005; ZETTER, 2015). The increasing extreme environmental events, added to the absence of a specific protection instrument and the lack of consensus on an appropriate concept to refer to these displaced people, have mobilized academic, political and legal efforts to guarantee protection and access to fundamental rights. In order to research this phenomenon, the starting point is the evaluation of environmental public policies aimed at forced displaced people, as a way of interpreting the implemented guarantees. At first, the cycle of public policies assumes that implementation is an intermediate stage between formulation and evaluation, thus, the analysis at this stage allows necessary adjustments to effectively reach the objectives (ARRETCHE, 2001; SOUZA, 2006; LOTTA , 2014; SAVY, 2018). To do so, initially, the historical evolution of the insertion of the environment in the instruments of international protection is approached, as well as its adoption by the Regional Systems of Human Rights, specifically, the European and the Inter-American ones. It follows for an approach of the legislation that treats the environment in two countries, namely: Brazil and Portugal. It is necessary to analyze the concepts and some specificities about degradation, environmental damage and human vulnerability adopted by the legislation of these countries. Thus, with regard to forced displacements, this analysis seeks, through an updated literature review, to contribute to the debate on the conceptualization of forced displacements due to environmental causes, as well as the instruments of protection for these individuals, based on International Refugee Law, of the 1951 Convention for Refugees and of the 1967 Additional Protocol. With this, the evaluation of public environmental policies implemented in Brazil and Portugal in the period 2000-2022 that adopt the protection of forced displaced people as their objectives. Finally, through a comparative study, we seek to explore Risk and Disaster Management by the countries that are the object of this study, with the aim of proposing adjustments that allow for greater effectiveness in the policies adopted. Therefore, this research starts from a qualitative approach, with exploratory and comparative purposes. Presenting documents and technical reports produced by various organizations, such as IOM Brazil, IOM Portugal, Movement of Affected by Dams (MAB), World Meteorological Organization (WMO), Intergovernmental Panel on Climate Change (IPCC).
